AItoSong.com - License Agreement

Effective Date: February 5, 2026

This License Agreement ("Agreement") is a binding agreement between Dreamspark AI LLC, a company registered in the United States ("Company," "we," "us," or "our"), and you ("User" or "you") regarding content generated through AItoSong.com (the "Service").

This Agreement supplements the Terms of Service and is incorporated into them. If any provision here conflicts with the Terms of Service, the Terms of Service control.

By generating music, songs, or lyrics through the Service, you confirm that you have read and accepted this Agreement.

1. Platform and Scope

AItoSong.com is an AI music creation platform that lets users turn prompts, lyric drafts, and text descriptions into songs, music, and lyrics.

"AI music" or similar descriptive terms in this Agreement refer to the platform capabilities of the Service and not to a separate standalone product.

The Service currently includes these primary generation workflows:

AI Song Generator - generates songs with vocals and instrumental backing
Text to Music - generates instrumental or background music
Lyrics Generator - generates lyrics in text form

The Service may also offer post-generation tools, including but not limited to:

Extend
Vocal Remover
Get Stems
Extract MIDI

Use of those post-generation tools does not change ownership or licensing eligibility, provided the original content was generated during an active paid subscription.

2. Paid Plans - Grant of Rights

2.1 Complete Ownership Transfer

Once you fully pay the fees for an eligible paid subscription plan, including but not limited to Starter or Plus, the Company transfers ownership of content generated during your active paid subscription period to you.

That ownership includes all right, title, and interest in:

Musical compositions
Sound recordings
Songs with vocals and/or instrumentals
Lyrics generated by the Lyrics Generator

Ownership is perpetual and remains in effect after cancellation or expiration of the paid subscription.

2.2 Intellectual Property Rights

For content generated during an active paid subscription, you receive all intellectual property rights available under applicable law, including:

Copyright ownership where applicable
Rights to reproduce, distribute, publicly perform, display, and broadcast
Rights to create derivative works
Rights to monetize and otherwise commercially exploit the content

The Company keeps no ownership interest in content generated during an active paid subscription.

2.3 Commercial Use Rights

Paid plan users may use generated content for any lawful commercial purpose, including but not limited to:

Advertising, branding, and marketing
Film, television, and video production
Social media content, whether monetized or not
Music streaming and distribution platforms
Games, applications, and software
Physical and digital product sales
Live or recorded performances

No additional royalty, fee, or credit line is required for commercial use.

2.4 Modification and Derivative Works

Paid plan users may edit, remix, adapt, combine, and otherwise modify generated content without restriction.

2.5 Attribution (Paid Plans)

Attribution is not required for paid plan users. If you choose to mention AItoSong.com, that is appreciated but optional.

3. Free Plan - No Ownership, No Commercial License

3.1 No Ownership Transfer

Content generated on the Free Plan remains the exclusive intellectual property of Dreamspark AI LLC.

Free plan users do not receive ownership, copyright, or any commercial license in generated content.

3.2 Limited License (Free Plan)

Free plan users receive a limited, non-exclusive, non-transferable, revocable license to use generated content only for personal, non-commercial purposes.

3.3 Prohibited Uses (Free Plan)

Free plan users may not:

Monetize, sell, license, or commercially exploit generated content
Distribute content for commercial gain
Upload content to stock libraries or marketplaces
Claim ownership or copyright in generated content
Remove or alter required attribution

3.4 Attribution Requirement (Free Plan)

When sharing content generated on the Free Plan, attribution to AItoSong.com is required. Acceptable examples include:

"Created with AItoSong.com (aitosong.com)"
"Generated using AItoSong.com"

3.5 Public Gallery Publication

Content generated on the Free Plan may be published automatically in the public Gallery. Removal requests may be sent to support@aitosong.com.

3.6 No Retroactive Rights

Upgrading from a free plan to a paid plan does not retroactively transfer ownership or commercial rights to content generated under the Free Plan. To receive those rights, the content must be generated again during an active paid subscription.

4. Commercial License Certificate

AItoSong.com may issue a Commercial License Certificate for an individual audio track generated during an active paid subscription.

The Commercial License Certificate:

Confirms that the track qualifies for commercial use under this Agreement and the Terms of Service
Serves only as a rights-confirmation document
Does not create new rights or expand existing rights
Does not guarantee originality, exclusivity, or non-infringement

5. AI-Generated Content Disclaimer

AI-generated music and lyrics may resemble existing works. The Company does not guarantee originality or non-infringement, and you remain responsible for ensuring your actual use of generated content complies with applicable law.

6. Warranties and Disclaimers

The Service and all generated content are provided on an "AS IS" and "AS AVAILABLE" basis. The Company disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, the Company's liability arising from or related to this Agreement is limited as described in the Terms of Service.

8. Termination

The Company may suspend or terminate access to the Service in accordance with the Terms of Service. Termination does not revoke rights already granted for content generated during an active paid subscription.

9. Governing Law

This Agreement is governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules.
